Chapter 14.37.200 Flood Damage Prevention Code Revision Background information:

 

Chapter 14.37.200 applies to those areas within the FEMA-designated Special Flood Hazard Areas (SFHA) (Zone AE or the 100-year floodplain), or within the regulatory Floodway, of the Coast Fork Willamette River, Silk Creek, Bennet Creek or the Row River. It does not apply to Zone X or 500-year floodplain areas.

The City is replacing our current Chapter 14.37.200 with new code language that includes the SAME CONTENT in a NEW FORMAT to comply with FEMA and the State of Oregon. The new code follows the recommendations of the 2019 State of Oregon Model Flood Hazard Management Ordinance.

The new code does not change the adopted FEMA map for Cottage Grove, which became effective on June 1, 1999. HOWEVER, the City has received notice of a potential Map Revision by FEMA in February 2020. This map revision will be brought out to the members of the community in the late summer/fall of 2020. We invite those in the potential SFHA to review the proposed code.

The Proposed Code includes changes that reflect the updates made by the State of Oregon to the model code under the guidance of FEMA, including:

Refined definition section.
Compliance with Oregon Specialty Codes.
Clarifications to floodway development standards.
Clarifications to Substantial Damage/Substantial Improvement requirements.
Requirements for flood development permits for all buildings, including accessory buildings that would be exempt from Oregon building code permit requirements, which are located within the SFHA.

 

This Model Code is now being used as the template for all Oregon communities participating in the National Flood Insurance Program.

Limitations on creation of new lots in hazard zones
